Many stakeholders are involved, i.e. commissioners, development agencies, artists, architects, engineers, fabricators, insurance broker/s, governmental bodies, councils and consultants to deliver the assignment. There are several contracts with other third parties, covering different parts and complexities of the project. The legally binding documents must be watertight and clearly stipulate each party’s responsibilities, financial commitments and deadlines, including reviewing and signing-off procedures. As usual the devil is in the detail and negotiations with the artist take place long before the building and outdoors are completed and the artwork is made. Under no circumstances should the artist begin working on the commission before the contract is finalised, agreed and signed. Method statements, risk assessments and various insurance covers, such ‘Public Liability’, ‘Professional Indemnity’ and ‘Employers Liability’ must be arranged prior to start.
